Andrew Hanen on Wednesday declared illegal a revised version of the Deferred Action for Childhood Arrivals (DACA) program, mandated by the Biden Administration. DACA has prevented deportation for hundreds of thousands of immigrants who were brought to the United States as children.

The ruling could spell the end of DACA, which has been in place for more than a decade. Judge Hanen agreed with Texas and eight other states that filed: The revised version put forth by the Biden Administration does not meet the legal deficiencies that led to his ruling in 2021. Judge Hanen has ordered that no new enrollments can take place in the DACA program and it is expected to be appealed.

For many DACA recipients, this legal battle carries great uncertainty. The program has allowed many of them to access education, employment, and the opportunity to achieve the American Dream as productive members of society. The Biden administration’s new version of DACA has not been enough to satisfy Judge Hanen’s concerns, and it remains unclear as to when a resolution will be reached on the matter. If appeals are unsuccessful, the Biden Administration would then need to seek a new approach to protect the Dreamers

As the legal battle commences, it is uncertain what the outcome for DACA will be. It is clear, however, that this ruling puts the future of the program, and the hundreds of thousands of people it protects, in doubt.
